In the current climate insolvency is a real concern for many companies and individuals. Do not despair, there may be options available to you! However, it is important that you take advice sooner rather than later. Reddy Charlton can advise you as to the options available to you and assist with implementing the chosen strategy.
Whether you are a creditor trying to get paid, a liquidator, receiver, examiner or an individual or company in financial difficulties, we can assist. Set out below are some of the areas in which we have particular experience:
One of our retail clients, Bestseller Retail Ireland Limited is the company behind a number of well-known clothing stores around the country, including Vera Moda and Jack & Jones. Following advice from Reddy Charlton, the company sought the protection of examinership after experiencing a very challenging trading environment in the preceding two years. The company has now come through the examinership process as a viable, fully functioning entity, having been able to agree mutually acceptable terms with almost all landlords and creditors. The company was advised throughout this process by Reddy Charlton, which included making applications to the court to repudiate a number of onerous leases.
We act for a group of hotels and bars, who following a difficult trading period, made the decision to liquidate a number of the companies by way of application to court for the appointment of a provisional liquidator, and to seek the protection of examinership in relation other group companies.
We have acted for a number of liquidators in relation to applications to court to have directors restricted or disqualified. Equally, we have successfully defended such applications on behalf of directors.
We have identified failings in procedures and documentation in bank loans and guarantees. These failings have been sufficient in some cases to undermine the banks’ claim entirely. In others, we have used them to negotiate satisfactory settlements.
